Ratio Decidendi

The court found that while the applicant's arguments regarding the legality of the sentence were unfounded, the fact that he had already served one year of a three-year sentence made it probable that a substantial part of the sentence would be served before the appeal was determined. This, coupled with the absence of opposition from the State and the applicant's conduct, constituted sufficient grounds to exercise discretion in favour of granting bail pending appeal. The court therefore ordered the applicant's release on bail of Ksh 100,000 with one surety, pending the appeal, and directed the preparation of a pre-bail report.
