The Court of Appeal held that once the Land Disputes Tribunal's award was adopted by the magistrates' court as a judgment, it became a valid and binding judgment, enforceable unless set aside or appealed through the statutory mechanisms provided by law. The respondents, having failed to exhaust the appeal process under the Land Disputes Tribunal Act and having consented to the adoption of the award, could not later challenge the judgment by way of a declaratory suit. The learned Judge of the trial court erred in declaring the tribunal's decision and the adopted judgment a nullity while the judgment remained unchallenged and valid.
