The Tribunal found that its jurisdiction is dependent on the existence of a tenancy relationship between the parties. Since the Tenant had vacated the premises and the tenancy relationship was severed, the Tribunal no longer had jurisdiction to entertain the Tenant's applications. The Tribunal further held that the prayers sought by the Tenant had been overtaken by events, as the Tenant was no longer in occupation of the suit premises and could not claim rights accruing to a tenant. The Landlord's claim for outstanding rent arrears was also abandoned.
