Criminal Appeal / Ruling on Application for Bail Pending Appeal

  1. 1 Whether the appellant is entitled to bail pending appeal.
  2. 2 Whether there are exceptional circumstances or substantial points of law to justify bail pending appeal.
  3. 3 Whether the appeal has overwhelming chances of success.

Ratio Decidendi

The court found that while the grounds of appeal are arguable, there are no exceptional circumstances or substantial points of law or evidence that would justify granting bail pending appeal. The sentence imposed is not illegal on its face, and although a substantial part of the sentence may be served before the appeal is heard, the appeal does not have overwhelming chances of success. The considerations for bail after conviction are different from those at trial, and the presumption of innocence no longer applies. Consequently, the application for bail pending appeal lacks merit and is dismissed.
