Respondent

Procedural Posture

Employment Cause / Final Award

  1. 1 Whether the respondent terminated the claimant's employment and if so, whether the termination was lawful and justifiable.
  2. 2 Whether the claimant is entitled to salary arrears for the years 2009, 2010 and 2011.
  3. 3 Whether the claimant is entitled to one month's salary in lieu of notice and severance pay.

Ratio Decidendi

The court found that the claimant did not respond to the respondent's letters requiring her to resume duty or attend a disciplinary hearing, and thus failed to utilize the internal grievance mechanisms available. As a result, the claims for unfair termination and notice pay were dismissed. However, the court determined that the employment contract and its renewal provided for a 25% annual increment on the claimant's basic salary, not a gratuity as argued by the respondent. The court awarded the claimant salary arrears for the years 2009, 2010, and 2011, but dismissed the claim for severance pay as it is only applicable in redundancy cases. Each party was ordered to bear their own costs.

Court Disposition

Partly allowed; claims for unfair termination, notice pay, and severance pay dismissed; salary arrears awarded.

Orders

  • The claim for unfair termination is dismissed.
  • The claim for one month's salary in lieu of notice is dismissed.
