Procedural Posture

Review Application / Ruling on Application for Review of Judgment

  1. 1 Whether the court should review its judgment to provide for interest on the awarded sum.
  2. 2 Whether the claim for loss of past earnings was specifically pleaded and allowable as special damages.
  3. 3 Whether interest on loss of past earnings should be awarded from the date of filing suit.

Ratio Decidendi

The court held that the omission to award interest on the sum of Kshs.156,078, representing loss of past earnings, was an error warranting review. Loss of past earnings is a special damage that must be specifically pleaded and proved, but in this case, the plaintiff sufficiently pleaded and proved his salary at the time of the accident. The court found that interest at 14% should be awarded on the sum from the date of filing suit, as the amount had accrued by trial. Furthermore, any amount paid under the Workman’s Compensation Act must be deducted from the final award, in accordance with statutory requirements. The judgment was reviewed to reflect these findings.

Application for review allowed in part; judgment reviewed to provide for interest and deduction of compensation paid under the Workman’s Compensation Act.
