In accordance with Order 16 Rule 5 of the Civil Procedure Rules, this period of inactivity qualified the suit for dismissal for want of prosecution. The absence of any opposition or appearance by the plaintiff further justified the dismissal. Consequently, the court dismissed the suit against the 1st and 2nd defendants and awarded them costs of the suit and the application.
