The plaintiff failed to provide a satisfactory explanation for the delay, and the court was not persuaded that the failure was due to the mistake of counsel. The court emphasized that it is the litigant's duty to ensure prosecution of his case. Furthermore, the court held that reinstating the suit would serve no useful purpose since the suit property had already been sold by the 1st defendant in exercise of its statutory power of sale, and the only remedy available to the plaintiff would be damages, not restitution of the property....
