Ratio Decidendi

The court found that the objector failed to prove that the motor vehicle KXK 245 was not the property of the judgment debtor at the time of attachment. The objector's reliance on the log book was insufficient in light of the judgment debtor's unequivocal admission of ownership in a letter to the plaintiff and the inclusion of the vehicle in a compromise settlement to which the objector, through his advocate, consented. The court held that the substance of the transaction and the admissions outweighed the formal registration, and thus the attachment was proper and valid. The objection was dismissed with costs.
