The applicants' claim to the suit lands was already the subject of prior succession proceedings, where their father had gifted the lands to the respondents and the applicants had been provided for with other land. The applicants' subsequent challenge to the succession orders was dismissed by the High Court for lack of merit and inordinate delay.
