The assertion of desertion was unsupported. The court concluded that the Claimant's employment was terminated without justifiable cause and in violation of due procedure, rendering the termination unlawful and unfair. Consequently, the Claimant was entitled to compensation for unfair termination and salary in lieu of notice, but not to service pay or overtime, as he was a contributing member of the National Social Security Fund and did not prove the overtime claim.
