Procedural Posture

Miscellaneous Application / Ruling on Sentence Consolidation and Review

  1. 1 Whether sentences in separate criminal cases can be consolidated.
  2. 2 Whether the applicant has served sufficient sentence to warrant release.

Ratio Decidendi

The court held that consolidation of sentences from separate criminal cases is legally unprocedural, as each case is distinct and must be punished separately. However, in reviewing the sentences, the court considered the purpose of sentencing, which is to reform rather than harden the offender, and the proportionality of punishment to the offence. The court noted that the applicant had already served seven years in prison, which was deemed sufficient given the value of the subject matter and the need for reform. Consequently, the court set aside the balance of the imprisonment terms and ordered the applicant's immediate release unless otherwise lawfully held.
