Procedural Posture

Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time and Stay of Execution

  1. 1 Whether the applicant has demonstrated sufficient cause for extension of time to file an appeal out of time.
  2. 2 Whether the applicant is entitled to an order of stay of execution pending appeal.
  3. 3 Whether provision of a bank guarantee as security is appropriate in the circumstances.

Ratio Decidendi

The court found that the applicant failed to satisfactorily explain the inordinate delay of over seven months in seeking extension of time to appeal. The reasons advanced, including late request for judgment copies and lack of clarity on when instructions were received, were not sufficient to constitute good cause. The applicant contributed to the delay and could not attribute it solely to the court. Without an order enlarging time, the request for stay of execution was untenable as there was no valid appeal in existence. Consequently, the application lacked merit and was dismissed.
