The court found that the delay in filing the appeal was not inordinate and was satisfactorily explained, as neither the applicant nor its advocates were aware of the judgment delivery due to lack of notice. The court exercised its discretion to grant leave to appeal out of time. On the issue of stay of execution, the court held that while the applicant did not prove substantial loss, the interests of justice required balancing the applicant's right to appeal with the respondents' right to enjoy the fruits of judgment.
