The court found that the respondent did not provide a convincing reason for the delay in filing the statement of response, as the rules allowed the response to be filed first and documents to be supplied later. However, in the interest of substantive justice and given that the respondent had already filed the response and entered appearance on time, the court determined that both parties should be heard on the merits. The respondent's offer to pay throw away costs to the claimant was accepted as a condition for granting the application. The court thus allowed the respondent's application to file the statement of response out of time, subject to payment of throw away costs.
