Ratio Decidendi

The court found that the plaintiff, by her letter dated 24th February 2011, clearly opted out of the sale agreement and demanded a refund of her deposit. The defendants accepted this rescission and requested her account details for refund, which she failed to provide. The apartment was subsequently sold to a third party. The court held that the plaintiff's communication amounted to a renunciation of the contract, and upon acceptance by the defendants, the contract was discharged. As such, the defendants were not in breach, and the plaintiff was not entitled to a permanent injunction, specific performance, or damages for breach of contract. The suit was dismissed with costs to the defendants.
