Procedural Posture

Notice of Motion / Ruling on Application to Vacate Stay Order

  1. 1 Whether the withdrawal of the suit against the respondent renders the stay order of 26.6.2013 ineffective.
  2. 2 Whether the respondent was properly served with the notice of withdrawal as required by law.

Ratio Decidendi

The court found that the withdrawal of the suit against the respondent alone did not render the stay order ineffective because the subject matter of the suit remained the same and the respondent was central to the dispute. Furthermore, there was no evidence that the notice of withdrawal was served on all parties as required by Order 25 rule 1 of the Civil Procedure Rules, 2010. Therefore, the stay order issued on 26.6.2013 remained effective, and the application to vacate it was without merit.
