Ratio Decidendi

The court found that the claimant was terminated without notice or a hearing, in violation of section 41 of the Employment Act, 2007. The respondent failed to provide any evidence to justify the termination as required by sections 43 and 45 of the Act. The court held that the termination was unfair and wrongful. The claimant, having served with dedication and not contributed to the termination, was entitled to 12 months’ pay as compensation for unfair termination, notice pay, and payment for days worked in April 2017. However, as the claimant was a member of the NSSF, he was not entitled to service pay under section 35(6) of the Act.
