Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the Ileho Land Disputes Tribunal had jurisdiction to determine matters relating to title and ownership of registered land.
  2. 2 Whether the adoption and execution of the tribunal's award by the magistrate's court was lawful after the repeal of the Land Disputes Tribunal Act.
  3. 3 Whether the appellant was denied a fair hearing and the right to exhaust appellate procedures.

Ratio Decidendi

The court found that the Ileho Land Disputes Tribunal acted outside its statutory jurisdiction by adjudicating on matters of title and ownership of registered land, which are expressly excluded from its mandate under section 3(1) of the repealed Land Disputes Tribunal Act. The subsequent adoption and execution of the tribunal's award by the magistrate's court was therefore null and void. The court held that the proceedings and decisions of both the tribunal and the lower court were ultra vires and violated the law, rendering them a nullity. As a result, the appeal was allowed, the tribunal's decision and the lower court's ruling were quashed, and no orders as to costs were made.
