Ratio Decidendi

The court found that the claimant was not entitled to service pay because Section 35(6)(d) of the Employment Act expressly excludes employees who are members of the National Social Security Fund (NSSF) from receiving service pay. On the issue of termination, the court determined that the respondent did not accord the claimant due process as required under Section 41 of the Employment Act, which mandates a fair hearing before termination. As a result, the termination was deemed unfair. The court awarded the claimant six months' salary as compensation for unlawful termination, in addition to the amounts already consented to by the parties for notice pay, salary arrears, and accrued leave.
