The High Court held that the Land Disputes Tribunal and the Provincial Land Disputes Appeals Committee acted in excess of their jurisdiction by awarding two acres of the appellant's registered land to the respondent. The only matter referred to the Tribunal was the removal of a caution, not the subdivision or transfer of land. The Tribunal's statutory jurisdiction under section 3(1) of the Land Disputes Tribunals Act does not extend to issues of title or transfer of registered land. The Tribunal and Appeals Committee therefore acted unlawfully, and their decisions were set aside. The appeal was allowed, and the awards of both the Tribunal and the Appeals Committee were quashed.
