The court held that it cannot grant a stay of execution in respect of a negative order, as the lower court's judgment merely dismissed the suit with costs and did not require any party to do or refrain from doing anything. There is therefore nothing to stay except for costs. However, recognizing the need to preserve the subject matter of the appeal and avoid rendering the appeal nugatory, the court ordered that the existing caution over the suit properties remain in force until the hearing and determination of the appeal.
