Procedural Posture

Notice of Motion / Ruling on Application to Enjoin Interested Parties and for Substituted Service

  1. 1 Whether the registered proprietors of the suit properties should be enjoined as interested parties in the suit.
  2. 2 Whether leave should be granted for substituted service on the intended interested parties by public advertisement.
  3. 3 Whether the supporting affidavit was properly sworn by an authorized officer as required by law.

Ratio Decidendi

The court found that the deponent of the supporting and further affidavits in support of the application was neither a director nor an authorized officer of the 3rd Interested Party, and had not provided any evidence of such authority as required by Order 4 Rule 1(4) of the Civil Procedure Rules. In the absence of proof of authority, the affidavits were defective and the application was rendered incompetent. The court emphasized that the identity and authority of a deponent are critical, especially where objections have been raised. Consequently, the application to enjoin the registered proprietors as interested parties and for substituted service was struck out with costs.
