Procedural Posture

Criminal Petition / Ruling on Motion for Sentence Review

  1. 1 Whether the High Court has jurisdiction to review a sentence for defilement after the Court of Appeal has resentenced the applicant.
  2. 2 Whether the Supreme Court decision in Francis Karioko Muruatetu applies to mandatory sentences for offences other than murder.

Ratio Decidendi

The High Court has no jurisdiction to review or revise the applicant's sentence for defilement after the Court of Appeal has already resentenced him, particularly in light of the Supreme Court's clarification that its decision in Francis Karioko Muruatetu applies exclusively to mandatory sentences for murder. The applicant's reliance on Muruatetu is misplaced, as the offence in question is defilement, not murder, and the Supreme Court has expressly excluded such offences from the ambit of its earlier decision. Consequently, the application for sentence review is incompetent and must be struck out.
