The court found that the Applicant failed to prove entitlement to adverse possession because the suit property was not shown to be registered under any of the legal regimes in Kenya, and adverse possession can only be claimed against a registered proprietor. However, the Applicant established, on a balance of probabilities, the existence of a resulting trust: he paid the full purchase price, was granted a Power of Attorney, and has been in possession and control of the property since 1992.
