The court found that the Plaintiff/Applicant had established an error apparent on the face of the record, as the ruling delivered on 30th July 2024 was made before the expiry of the period granted for the Plaintiff and 1st Defendant to file their submissions in response to the 4th Defendant's application. This procedural irregularity prejudiced the Plaintiff's right to be heard. Furthermore, the court determined that the manner in which the 4th Defendant sought to introduce a counter-claim for adverse possession did not comply with the requirements of Order 8 and Order 37 of the Civil Procedure Rules, and was tantamount to instituting a new suit rather than amending an existing pleading....
