The plaintiff promptly engaged a surveyor and sought to produce the resulting report as additional evidence. The defence had not yet presented its case and would have an opportunity to respond to the new evidence, thus no injustice or prejudice would be caused. The court exercised its discretion to allow the application, set aside the earlier order closing the plaintiff's case, and permitted the production of the surveyor's report.
