Procedural Posture
Judicial Review / Ruling on Application for Leave to Commence Judicial Review Proceedings
Legal Issues
- 1 Whether the ex-parte applicant has established a prima facie case to warrant the grant of leave to commence judicial review proceedings.
- 2 Whether there is any opposition to the application for leave by the respondents.
Ratio Decidendi
The court found that, in the absence of any objection from the respondents and upon consideration of the applicant's arguments, the threshold for the grant of leave to commence judicial review proceedings had been met. The court emphasized that leave is a preliminary filter to ensure that only arguable cases proceed to substantive hearing. Since the Attorney General did not oppose the application and the applicant had set out sufficient grounds, leave was granted as sought.
Court Disposition
Leave to commence judicial review proceedings granted.
Orders
- Leave is granted to the ex-parte applicant to commence judicial review proceedings.
- The substantive motion shall be filed and served within 21 days.
