The High Court found that the appellants failed to demonstrate that the trial magistrate erred in principle or made an award that was inordinately high or low. The court held that the trial magistrate considered relevant factors and comparable precedents in awarding damages for pain and suffering, loss of expectation of life, and loss of dependency. The appellate court, therefore, found no justification to interfere with the quantum of damages awarded by the lower court and dismissed the appeal with costs to the respondents.
