Ratio Decidendi

The High Court found that the trial magistrate erred in failing to consider the residual stiffness of the appellant's thumb and the effects of inflation when assessing general damages. The award of Kshs. 230,000 was deemed inordinately low given the nature of the injuries and comparable awards in similar cases. The court substituted the award with Kshs. 280,000. On the claim for lost earnings, the court held that the appellant failed to strictly prove actual loss of income as required for special damages, lacking evidence of employment, incapacity, or actual earnings. The claim for lost earnings was therefore dismissed. The appellant was awarded costs for the appeal and in the lower court.

Court Disposition

Appeal partially allowed.
