The Plaintiff served a valid notice of termination, and the 1st Defendant's reference to the Tribunal was dismissed. As the Tribunal's dismissal was not stayed or set aside, the tenancy was terminated by operation of law as of 1st January 2017. The 1st Defendant's continued occupation thereafter was as a trespasser, not a tenant.
