The Tribunal found that the Respondents had not issued the statutory notice required under Section 4(2) of Cap 301 to increase the rent for shop No. 13, and therefore could not lawfully increase the rent from Kshs. 20,000 to Kshs. 45,000. As for shop No. 14, the Tribunal determined that no tenancy relationship existed between the parties because there was no agreement on rent and no rent had been paid by the applicant for that shop. The Tribunal held that the applicant is entitled to injunctive relief restraining the Respondents from increasing the rent or evicting her from shop No. 13, but not entitled to similar relief regarding shop No. 14. The parties are at liberty to negotiate terms...
