Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the trial court's award of Ksh. 3,500,000 in general damages was excessive and warranted appellate interference.
  2. 2 Whether the award of Ksh. 1,000,000 for permanent prosthesis was justified based on the evidence and expert reports.
  3. 3 Whether the award of Ksh. 1,500,000 for diminished earning capacity was supported by the evidence and legal principles.

Ratio Decidendi

The appellate court found that the trial court's award of Ksh. 3,500,000 in general damages was inordinately high compared to awards in similar cases for comparable injuries, and thus substituted it with Ksh. 2,500,000. The court upheld the award of Ksh. 1,000,000 for permanent prosthesis, finding that the trial court properly exercised its discretion in preferring Prof. Ating'a's expert opinion, and that the evidence supported a range up to Ksh. 1,000,000. The award of Ksh. 1,500,000 for diminished earning capacity was also upheld, as it was within the range justified by the respondent's age, disability, and minimum wage calculations, and there was no evidence to warrant interference....

Court Disposition

Appeal partly allowed.
