The court found that, although the offences were committed on different dates and at different times, they were intricately interconnected and all geared towards achieving a particular objective—obtaining money from the complainant by use of forged documents. The acts constituting the respective counts formed part of one transaction. Therefore, the trial magistrate ought to have imposed concurrent sentences. The court exercised its discretion to direct that the sentences imposed upon the applicant in Machakos Chief Magistrate’s Court Criminal Case No. 351 of 2016 run concurrently from 22nd November, 2018.
