However, the appellant's claim was based on trespass, and the court held that the appellant failed to prove that the respondent was a trespasser. The evidence showed that the respondent entered and remained on the suit land as the wife of the appellant's deceased son, established a matrimonial home, and lived there for several years without objection. There was no evidence that the appellant objected to her presence until after the death of his son, nor was there proof that she was married...
