Ratio Decidendi

The court found that the 2nd claimant's claim for reimbursement of deducted salary was a continuing injury, as the pay cuts persisted for 11 months. Under section 90 of the Employment Act, such claims must be brought within 12 months of cessation of the injury. The pay cuts ceased in January 2016 when the claimant's full salary was restored, but the suit was filed on 24th April 2017, outside the statutory period. The court held that it lacked jurisdiction to entertain the claim as it was statute barred, and accordingly struck out the claim without considering the merits of the pay cut's lawfulness or entitlement to reliefs.
