The President, exercising constitutional powers under Article 133 and pursuant to Gazette Notice No. 9566 of 19/7/2023, had commuted all death sentences for capital offenders as at 21/11/2022 to life imprisonment. The petitioner, having been sentenced before that date, was among those whose sentences were commuted. As a result, the basis for challenging the constitutional validity of the mandatory death sentence no longer existed in the petitioner.s case, rendering the petition misplaced and subject to being struck off.
