The application was made without undue delay, and the appellants expressed willingness to provide security. The court applied the principles under Order 42 rule 6 of the Civil Procedure Rules, 2010, and relevant case law, concluding that the threshold for stay of execution pending appeal was met. The stay was granted on condition that the 2nd appellant deposits Kshs. 500,000 as security for costs within 45 days, failing which the stay would lapse.
