Procedural Posture

Criminal Revision / Ruling on Application for Sentence Review

  1. 1 Does the High Court have jurisdiction to review a sentence imposed by a judge of equal jurisdiction?
  2. 2 Was the period spent in pre-trial custody properly considered in sentencing?
  3. 3 Has the applicant established grounds for sentence review under the Constitution?

Ratio Decidendi

The High Court, differently constituted, has no jurisdiction to review or alter the sentence imposed by another High Court judge; such power lies exclusively with the Court of Appeal. Even if jurisdiction existed, the trial judge had already considered the period spent in pre-trial custody and imposed a sentence that reflected all relevant circumstances, including the plea agreement and mitigation. The application for sentence review was therefore without merit and was dismissed.
