Ratio Decidendi

The court found that the applicant failed to prove that the advocate-client relationship ended in 2007 or that the primary suit was determined over ten years ago. The evidence provided did not establish that the taxation proceedings in 2007 related to the same suit as the impugned bill of costs. The respondent’s evidence that the retainer was terminated on 13th November 2017, when the court allowed the application to cease acting, was accepted. Therefore, the cause of action accrued on 13th November 2017, and the bill of costs filed on 16th November 2017 was within the statutory limitation period. The application to strike out the bill of costs as time barred was dismissed.
