Ratio Decidendi

The court found that the advocate-client relationship was terminated on 15th July 2011 when the primary suit (Milimani CMCC No. 796 of 2004) was concluded, as evidenced by the trial court record. The advocate failed to provide evidence that his retainer was terminated at a later date. Consequently, the six-year limitation period for filing the bill of costs began on 16th July 2011 and expired on or about 17th July 2017. Since the bill of costs was filed on 16th November 2017, it was outside the statutory limitation period and therefore time barred. The application to strike out the bill of costs was merited and allowed.
