Procedural Posture

Miscellaneous Application / Ruling on Notice of Motion to Strike Out Advocate Client Bill of Costs

  1. 1 Whether the advocate-client bill of costs is statute barred under the Limitation of Actions Act.
  2. 2 When time begins to run for purposes of limitation in respect of an advocate's claim for costs.
  3. 3 Whether sufficient evidence was provided to establish the date of termination of the retainer or conclusion of the suit.

Ratio Decidendi

The court found that there was insufficient evidence to establish when the underlying suit was concluded or when the advocate-client relationship was terminated. Without clear proof of these dates, the court could not determine when the statutory limitation period began to run. Consequently, the respondent's application to strike out the bill of costs on grounds of limitation could not be sustained, as the burden of proof was not discharged. The motion was therefore dismissed for lack of merit.
