Ratio Decidendi

Upon dismissal of the appeal, the conditional stay of execution ceases to operate, and the deposited decretal sum must be released to the decree holder. The Appellant's counsel's failure to sign the consent for release of funds is unjustified and constitutes an unreasonable delay, which is contrary to the equitable principle that delay defeats equity. The court therefore orders immediate release of the deposited sum with accrued interest to the 1st Respondent through her advocates, ensuring enforcement of the judgment and upholding the right of the successful party to enjoy the fruits of her judgment.
