The court found that the applicants and their extended family have been in occupation of the suit land for decades and that eviction would cause them substantial loss, including homelessness and loss of dignity. The court was satisfied that the applicants had demonstrated the likelihood of suffering substantial loss if the stay was not granted. The court also considered that the application was made without unreasonable delay. Consequently, the court exercised its discretion to grant a stay of execution of the judgment and issued a conservation order over the suit land pending the hearing and determination of the intended appeal. Costs were ordered to be in the cause.
