Ratio Decidendi

The tribunal found that the tenants/applicants admitted to owing rent arrears but were entitled to a waiver for the months when the landlord disconnected electricity, rendering the premises unfit for business. The tribunal rejected the landlord's calculation based on a higher rent and instead adopted the agreed rent of KES 50,000 per month. The tribunal accepted the tenants' calculation of arrears at KES 184,500 and ordered payment of this amount. The tribunal also awarded costs of KES 40,000 to the tenants, to be waived against the rent account, as the landlord's conduct contributed to the dispute and the tenants substantially succeeded in their application.

Orders

  • The tenants shall pay the 1st respondent/landlord the admitted amount of KES 184,500 within the next 30 days, failing which the landlord is at liberty to levy distress against the tenants in recovery of the said rent arrears.
