Ratio Decidendi

The High Court determined that it no longer had jurisdiction to hear and determine the dispute, as the matter concerns land ownership and trespass, which now fall exclusively within the jurisdiction of the Environment and Land Court pursuant to Article 162(2) and Article 165(5)(b) of the Constitution. The transitional provisions that previously allowed the High Court to continue hearing such matters are now spent, following the establishment and full operationalization of the Environment and Land Court. Accordingly, the High Court must down its tools and transfer the file and all pending applications to the Presiding Judge of the Environment and Land Court for further directions.
