Ratio Decidendi

The court held that the Employment and Labour Relations Court does not strictly apply the rules of evidence regarding the production of documentary evidence. Rule 14(4) and Rule 21 of the Employment and Labour Relations Court (Procedure) Rules 2016 allow the court to admit documents without requiring their makers to be called for cross-examination, unless there is a specific allegation of fabrication. Since the receipts in question originated from the Claimant and there was no allegation of fabrication, the objection to their admissibility was without merit. The Respondent was therefore allowed to produce the receipts as evidence, and the objection was overruled.
