Procedural Posture

Civil Appeal / Ruling on Interlocutory Application for Release of Attached Motor Vehicle and Stay of Execution Pending Appeal

  1. 1 Whether the application for release of the attached motor vehicle and stay of execution is merited pending determination of the appeal.
  2. 2 Whether the respondents' continued holding of the motor vehicle is justified after full satisfaction of the decretal sum.
  3. 3 Whether the application is premature as it seeks final orders at an interlocutory stage.

Ratio Decidendi

The court found that the application sought orders similar to those already determined by the trial court in its ruling of 16th December 2024, which is the subject of the pending appeal. Granting the orders sought at this interlocutory stage would effectively determine the substantive appeal and render it moot. The court held that it would be premature to consider the merits of the application before the appeal is heard and determined. The appropriate course is for parties to expedite the hearing of the appeal, and the application for release of the motor vehicle and stay of execution is declined. Costs of the application will abide the outcome of the appeal.
