Ratio Decidendi

The court found that although the marriage between the parties was validly celebrated in Zambia and recognized by the government of Zambia, the petitioner failed to satisfy the domicile requirements under the Marriage Act, 2014. The pleadings did not provide proof of domicile of either party in Kenya, and it was apparent that the respondent was domiciled in Zambia. The court was unable to ascertain the domicile of the petitioner. As a result, the court held that it lacked jurisdiction to dissolve the marriage under Kenyan law due to non-fulfillment of the statutory domicile requirements. Consequently, the petition for dissolution of marriage was dismissed.
