The High Court found that the applications before it sought relief that had already been determined in a previous appeal, rendering the issues res judicata. The applicant's repeated filing of similar applications in different courts constituted an abuse of process and forum shopping. The court further noted the applicant's failure to disclose material facts in ex parte applications, undermining her credibility and the integrity of the proceedings. The court concluded that there were no cogent grounds for either a stay of proceedings or transfer of the suit, and that the lower court had the requisite jurisdiction to hear the matter. Accordingly, both applications were dismissed with costs.
